Introduction and Article 1: Definitions.
Please read these terms and conditions carefully. By using our services and products, you agree to these terms, which constitute a legally binding document. Ensure that you fully understand them.
Ministry of Helpers (“MoH”) is an international online platform designed to connect employers and domestic helpers. Our services and products facilitate the recruitment and employment process for domestic helpers. By using our services and accessing the platform, you consent to these terms and conditions.
MoH is an independent online platform that partners with registered Employment Agencies (EA) in, but not limited to, Singapore, Philippines, Indonesia,
These general terms and conditions of sale and use of the MoH functionality on the ministryofhelpers.com website (hereinafter referred to as the “General Terms and Conditions” or “GTC” and “The Website”) set out the conditions for accessing and using the online platform and services through the website https://ministryofhelpers.com and define the relationship framework between Members and MoH.
MoH offers the following services:
- MoH provides its stakeholders such as domestic helpers, employers and agencies with technical tools to facilitate domestic workers finding suitable employment and employers finding suitable helpers.
- MoH hosts assignments, offers, requests, and content generated by MoH and its stakeholders
- MoH does not act as an agent in any capacity, nor as a domestic helper; nor employer, it solely serves as a platform connecting employers and domestic helpers.
- MoH’s obligations are limited to providing the means necessary to connect domestic helpers and employers and assisting them accordingly.
- MoH does not manage, oversee, or guarantee employment relationships or outcomes.
Article 1: Definitions
In these General Terms and Conditions, words or expressions beginning with a capital letter, whether used in the singular or plural, shall have the following meanings:
- “Agency Partner”: Refers to the accredited maid agencies with whom the Website has established partnerships.
- “Assignment”: Refers to the service conferred upon the domestic helper by the employer.
- “Concierge Services”: Refers to a service available for purchase on the Website, where an Employer seeking to directly hire a Domestic Helper is referred to Agency Partners to facilitate the processing of the required hiring paperwork.
- “Content”: Refers to all offers, literature, messages, or information of any nature (e.g., text, images, videos, photographs, comments, marks, company names) uploaded by a Member.
- “Direct Hire”: Refers to the process where an Employer independently selects and hires a Domestic Helper without going through a traditional agency, utilising the Website’s tools and services to facilitate the connection and, if required, the processing of hiring paperwork through Agency Partners.
- “Domestic Helper”: Refers to a Member registered on the Website willing to carry out the Assignment requested by the Employer or offering Personal Assistance Assignments to Employers.
- “Employer”: Refers to a Member, a natural person, wishing to hire the services of a Domestic Helper via the Platform.
- “Member”: Refers to a Domestic Helper or Employer using the Website.
- “Personal Assistance Service”: Refers to all services offered by Domestic Helpers.
- “Platform”: Refers to the structure implemented by MoH, accessible online at https://www.ministryofhelpers.com.
- “Premium Subscription”: Refers to a paid subscription granting the Employer access to the paid services offered by MoH for a specified duration, which is tacitly renewable for a term equivalent to the originally selected period.
- “Service”: Refers to all paid or free services offered by the Platform.
- “User”: Refers to any person using the Platform, whether as a visitor or Member.
- “Verification”: Refers to a free option indicating whether a Domestic Helper has undergone specific verification.
- “Website”: Refers to the MoH functionality on the website https://ministryofhelpers.com.
Article 2: Intellectual Property
Content Shared by MoH
All elements constituting the Platform (e.g., drawings, images, text, logos) are the exclusive property of MoH. Generally, Users are granted a personal, non-exclusive, and non-transferable right to access and use the Platform. Any other rights are expressly excluded without prior written consent from MoH.
The MoH trademarks and the ministryofhelpers.com domain name are, and remain, the exclusive property of Ministry of Domestic Helpers Pte Ltd.
Content Shared by the User
MoH holds a licence to use the intellectual property rights associated with the content provided by Users for distribution on the Platform.
The User expressly authorises MoH to amend the aforementioned content to comply with the Platform’s style requirements or to make it compatible with technical performance requirements or media formats.
Users grant an international, non-exclusive licence to use the information and/or data provided. Users remain solely responsible for the content of the information and/or data. MoH reserves the right to delete any content deemed illegal, morally objectionable, or in violation of intellectual property rights.
When uploading information to the Website, Users may restrict or prohibit its use by notifying MoH via the Website or by post to: 195 Pearl's Hill Terrace, Singapore 168976.
Article 3: Accessing and Using the Website
Accessing the Website
The Website is accessible 24 hours a day, seven days a week. However, MoH reserves the right, without prior notice or compensation, to temporarily suspend the Platform or access to remote services for maintenance, updates, or amendments to the servers.
MoH also reserves the right to modify or enhance the Platform and services at any time.
In the event of temporary or prolonged unavailability of the Platform due to technical issues or permanent closure, MoH cannot be held liable for any damage, except for damage directly resulting from the failure to fulfil its obligations outlined herein.
MoH provides no guarantee of uninterrupted functionality of the Platform or that servers hosting the Website or linked third-party sites are free from viruses.
MoH is not liable for Users’ inability to connect to the Platform due to technical issues.
Connecting Members
The Platform facilitates connections between:
- Employers: Registered users seeking domestic helpers to perform Personal Assistance Assignments.
- Employers must have full legal capacity and comply with Singapore’s minimum hiring age requirements.
- Employers’ use of the Platform must be for personal needs, not for reselling, leasing, or commercial activities.
- Domestic Helpers: Individuals aged 21 or older offering Personal Assistance Assignments. Employment agencies are not permitted to register as Domestic Helpers.
The Platform serves as a connecting tool between Employers and Domestic Helpers and does not process official paperwork.
- Agency Partners: When an Employer purchases a Concierge Package, the Website will refer the Employer and Helper to an accredited Agency Partner, who can process the paperwork
Due Diligence
- Employers and FDWs are solely responsible for verifying the accuracy of profile information, including identity, qualifications, and employment history.
- Employers must ensure compliance with Ministry of Manpower (MOM) regulations for hiring FDWs.
Liability for Misinformation
- MoH is not liable for disputes or issues arising from errors, omissions, or misinformation provided by Employers or FDWs.
- If paperwork errors arise due to misinformation, Employers and FDWs bear sole liability. Refunds for unused portions of Concierge Services are at MoH’s discretion.
Compliance with ICA and MOM Requirements
- Employers must ensure their chosen FDWs meet ICA and MOM requirements, including valid entry permits, work permits, and other documentation.
- MoH and its accredited partner agencies are not liable for ICA or MOM offences, including denied entry or fines due to non-compliance.
Limitations of Liability
- MoH provides tools to facilitate employment but is not a party to any agreements between Employers and FDWs.
- MoH is not liable for:
- Disputes or breaches arising from employment arrangements.
- Accuracy of User-provided information or communication.
- Non-compliance with MOM or ICA requirements.
Restrictions
Legal or natural persons acting on behalf of legal entities, such as employment agencies, may not register on the Platform without prior written consent from MoH. Such entities are also prohibited from:
- Contacting Domestic Helpers via the Platform.
- Extracting or using the Platform’s database for commercial or research purposes.
MoH reserves the right to ban any User found to be in breach of these restrictions and may take legal action as necessary.
Article 4: Conditions for Accessing the Service
The price of Premium Subscriptions is available on the Website. From time to time, promotional codes (promo codes) may be issued, providing discounts or free subscription days.
Promo Code Conditions
By accepting these terms, Employers acknowledge that promo codes:
- May only be used as specified in the conditions established by MoH.
- Cannot be duplicated, sold, transferred, or made publicly available without MoH’s express consent.
- May expire before use and be deactivated by MoH at any time.
MoH reserves the right to invalidate any promo code and/or related subscriptions if it suspects misuse, fraud, or breach of the conditions. In such cases, MoH may:
- Terminate the Member’s account.
- Seek reimbursement for any misuse of promo codes.
Automatic Renewal
- Premium Subscriptions are automatically renewed for the same term as initially chosen. Members can opt-out of automatic renewal at any time by selecting “Stop the automatic renewal” under the “My Account” section.
- Employers are informed of the automatic renewal policy at the time of payment for the subscription.
- Cancellation and Refund Policy
- Failure to cancel before the renewal date will result in the automatic renewal of the subscription, and no refunds will be issued.
Refunds for unused portions of Concierge Services, if applicable, are at MoH’s discretion and will only be considered under exceptional circumstances.
Article 5: Description of the Services
Internal Messaging Service
Employers and Domestic Helpers may exchange written messages once mutual contact has been established and accepted.
- Employers and FDWs must use the platform only for lawful purposes consistent with MoH’s Terms and Conditions.
- All initial communications must occur via the MoH platform. Users must not bypass the system for unauthorised direct contact.
- To ensure the safety and compliance of all parties, MoH may monitor messages and interactions on the platform for the following purposes:
- Detecting and preventing fraud, harassment, or abuse.
- Ensuring adherence to local laws and MoH’s Terms and Conditions.
- Facilitating dispute resolution in cases where platform rules have been violated.
- Monitored data will remain confidential unless disclosure is required by law or necessary to protect the safety of Users and the integrity of the platform.
- Users are advised to keep communications respectful and professional and avoid sharing sensitive information outside the platform’s secure messaging system.
Assignment Request
- Employers and Domestic Helpers freely negotiate employment terms and rates, provided they comply with applicable legislation.
- MoH does not guide or advise Employers regarding their selection of Domestic Helpers. Employers bear sole responsibility for ensuring compliance with relevant laws and for drawing up appropriate contracts.
- MoH does not guarantee that Domestic Helpers possess all necessary documentation to work in their respective countries, including Singapore.
Employer Responsibilities
Employers must provide all information and resources required for Domestic Helpers to fulfil assignments and undertake to compensate them accordingly.
Article 6: Feedback
From time to time, MoH may request feedback or conduct polls among Members. MoH reserves the right to publish ratings or poll results at its sole discretion. Members acknowledge and accept that such feedback may be displayed on the Platform or via other channels.
Article 7: Roles and Responsibilities
Responsibilities of Members
Users of the Platform must:
- Use the Platform solely for its intended purpose as defined in these terms.
- Avoid disclosing personal information on their profiles that would enable direct contact without utilising the services offered by MoH.
- Refrain from uploading content or engaging in behaviours that disrupt or degrade the normal use of the Platform, such as spamming or distributing harmful software.
- Avoid posting any content that is defamatory, offensive, obscene, violent, discriminatory, or otherwise inappropriate.
- Abstain from sharing links to third-party websites containing illegal or non-compliant material.
Users must also refrain from sharing contact details (e.g., surname, address, email, phone number) with others through the Platform unless explicitly permitted by MoH.
By using the Platform, Users agree to indemnify MoH, its directors, employees, agents, and affiliates against any third-party claims arising from breaches of this agreement.
Responsibilities of MoH
MoH and Members operate independently, with each party acting in their own name and on their behalf.
MoH does not enter into agreements on behalf of Domestic Helpers or Employers. Any agreements between Members are entered into directly and independently, without MoH’s involvement. Consequently, MoH cannot be held liable for any disputes, difficulties, or damages arising from these agreements.
MoH does not guarantee the quality or suitability of Assignments completed by Domestic Helpers. Members must take responsibility for ensuring compliance with all relevant regulations when forming agreements.
Third-Party Agencies and Risks
While MoH partners with licensed and ethical employment agencies, it does not assume responsibility for the outcomes of interactions with such agencies. Members must independently verify agency credentials and licences before entering into agreements.
MoH is not liable for damages, costs, or risks arising from decisions made by Members, whether hiring directly or through third-party agencies.
Article 8: Penalties for Non-Fulfilment
Any misuse of the platform, including but not limited to providing false information, breaching MOM or ICA regulations, or bypassing communication protocols, may result in:
- Profile restriction.
- Suspension or blocking of the User account.
- Blacklisting from the MoH platform.
- Take legal action, including notifying and cooperating with relevant authorities.
No refunds will be issued for subscription fees in cases of non-compliance.
Article 9: Suspension and Termination
Deactivation of a Member’s Account
Members may temporarily deactivate their accounts, preventing them from appearing in search results. Accounts can be reactivated at any time.
Termination of a Member’s Account
In cases of serious breaches of these terms, MoH may terminate a Member’s account without notice. Termination will not prejudice MoH’s right to seek damages for any harm caused by the breach.
Article 10: Privacy and Personal Data Protection Policy
MoH values the privacy of its Users and has established a clear Privacy and Personal Data Protection Policy, in compliance with Singapore’s Personal Data Protection Act (PDPA).
Data Collection
MoH collects information to facilitate efficient and personalised connections between Employers and Domestic Helpers. Information collected includes:
- Mandatory details such as name, email address, phone number, and password upon registration.
- Additional information provided voluntarily to enhance matching results.
By registering, Members agree that their profiles and content may be visible to others on the Platform.
Use of Information
MoH uses collected information for:
- Providing and improving services.
- Conducting customer support, trend analysis, and service optimisation.
- Investigating breaches of these terms or illegal activities, where necessary.
Data Sharing
MoH does not share data with third parties unless:
- Required by government regulations or legal processes.
- Explicit written consent is provided by the Member.
MoH may disclose personal information to comply with legal obligations or to protect the safety of Users.
Security Measures
MoH employs technical, administrative, and physical safeguards to protect User data. Despite these measures, Members are advised to take precautions to secure their accounts, including protecting login credentials and avoiding payments through the Platform.
Member Rights
Members have the right to request copies of their personal data held by MoH and to request corrections of inaccurate information. MoH will comply with these requests within 40 days, as per statutory requirements.
By using the Website, Users (as defined below) acknowledge that they have read, understood, and unreservedly accepted these General Terms and Conditions. Moreover, by using the Website, Users confirm their acceptance of the Privacy and Personal Data Protection Policy.
MoH may amend or update these General Terms and Conditions and the Privacy and Personal Data Protection Policy at any time. The applicable version of the General Terms and Conditions and the Privacy and Personal Data Protection Policy at the time of website usage shall be binding on the user.
Users are advised to stay updated on the currently applicable General Terms and Conditions. The latest version of these documents can be viewed at any time by clicking on the “Terms and Conditions” link available on the website.
By registering and subscribing to the MoH platform, employers acknowledge and agree to comply with all applicable Ministry of Manpower (MOM) regulations. In the event of a violation, MoH reserves the right to restrict, suspend, or terminate the employer’s account, regardless of their subscription status. Furthermore, MoH’s decisions regarding account restrictions or terminations are final and binding. By using the platform, employers accept and agree to these terms in full.
Article 11: Survival
If any provision of these General Terms and Conditions is deemed invalid or unenforceable due to legislative changes or a court decision, the validity of the remaining provisions will remain unaffected.
Article 12: Applicable Law – Competent Courts
In the unlikely event of a legal dispute, these General Terms and Conditions shall be governed by, and construed in accordance with, the laws of Singapore, irrespective of the User’s location or the place where the services were accessed.
The competent courts in Singapore shall have exclusive jurisdiction over any disputes arising from these terms.
